Terms of Use

These terms are the agreement between you and us for the Wysp app and the wysp.co.uk website. Wysp is provided by TwinPine Digital, a sole trader based in the United Kingdom, trading as Wysp ("we", "us", "our"). By downloading, installing or using Wysp, or by using this website, you agree to these terms. If you don't agree, please don't use Wysp. You can reach us at [email protected].

1. Your licence to use Wysp

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Wysp on Macs you own or control, for your own personal or internal business use. That's it, and that's plenty for what Wysp is for.

Wysp is proprietary, closed-source software. Except where the law says we can't stop you (for example limited rights to make a back-up or to achieve interoperability), you may not copy, sell, rent, lend, sub-licence or distribute Wysp, and you may not reverse-engineer, decompile, disassemble or otherwise try to extract its source code or models. We own all the intellectual property in Wysp, this website, and the Wysp name and branding. Any third-party open models Wysp builds on remain under their own licences.

2. It's a beta

Wysp is currently in beta. That means it may contain bugs, may change, and may occasionally get things wrong or be unavailable. It's provided "as is". Please don't rely on it for anything critical, and keep your own copies of anything important.

3. Fair use

Don't use Wysp or this website to break the law, to infringe anyone's rights, to get around its technical protections, or to disrupt the service or the systems behind it. If you send us feedback or a bug report, don't include unlawful, abusive or infringing content.

4. Free now, maybe paid extras later

The core of Wysp is free, and the core stays free. We may offer optional paid features in future. If we do, the price is shown to you before you pay, payments are handled securely by Stripe (we never see or store your card details), and paid features are intended as a one-off purchase, not a subscription. Nothing here obliges us to build any particular paid feature.

5. If you ever buy something: your right to change your mind

If you're a consumer in the UK or EU and you buy a paid feature, you normally have 14 days to cancel for a refund. Because a paid feature is digital content supplied immediately, we'll ask you at checkout to agree to it being made available straight away and to acknowledge that, once we begin supplying it, your 14-day right to cancel ends. Until then the right stands. None of this affects your legal rights under the Consumer Rights Act 2015 — digital content must be as described, of satisfactory quality and fit for purpose, and if it isn't you're entitled to a repair, replacement or refund as the law provides.

6. Privacy

Wysp runs on your own Mac and is built to keep your typing on your device. Exactly what is and isn't processed — including the anonymous usage count and the opt-in feedback — is set out in our Privacy Policy, which forms part of these terms.

7. No warranty (within the limits of the law)

To the fullest extent the law allows, Wysp and this website are provided "as is" and "as available", without warranties of any kind. We don't promise they'll be uninterrupted, error-free, or that the suggestions will suit any particular purpose. This does not exclude or limit anything that can't legally be excluded, including the statutory rights of consumers and any terms implied by law that can't be excluded.

8. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded under UK law — and if you're a consumer, your statutory rights are unaffected.

Subject to that: we are not liable for any indirect or consequential loss, or for loss of data, profits, revenue or goodwill; you are responsible for your own data and back-ups; and our total liability to you for any claim that can lawfully be limited is capped at the greater of the amount you paid us in the 12 months before the claim and £50. Since the core of Wysp is free, for most people that cap is effectively nil.

9. Changes to Wysp or these terms

We may update Wysp and these terms as the product develops. If we make a material change to these terms, we'll say so on this page and, where it matters, in the app. Carrying on using Wysp after a change means you accept the updated terms.

10. Ending this agreement

You can stop using Wysp and delete it at any time. We may suspend or withdraw your access if you break these terms. Sections that by their nature should survive (intellectual property, liability, and governing law) continue to apply after this agreement ends.

11. Law and where disputes are heard

These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer resident elsewhere in the UK or the EU, you keep the benefit of any mandatory protections and the right to bring proceedings in your home courts where the law gives you that right.
